Why didn't Muhammad forbid the rape of slave girls?

Question: If women are captured in battle do you suppose those women a) would want to sleep with the soldiers who had presumably killed or captured their husbands/fathers/brothers b) would be in a position to refuse the advances of the soldiers? 
Here's another question: What do we call having sex with a woman against her will?

When Muhammad's followers asked him about using coitus interruptus with women captured in battle, rather than taking the opportunity to give them a moral lesson in not forcing themselves on women (rape) or the inhumanity of slavery, or the moral degeneracy of having sex in such an unequal partnership, he simply told them ... to go ahead. We know this because it is reported in a sahih (utterly reliable) hadith (saying or action of Muhammad) as follows:

[From Muslim] @Book 8, Number 3373: Abu Sa'id al-Khudri (Allah be pleased with him) reported: We took women captives, and we wanted to do 'azl (coitus interruptus) with them. We then asked Allah's Messenger (may peace be upon him) about it, and he said to us: Verily you do it, verily you do it, verily you do it, but the soul which has to be born until the Day of judgement must be born. 

Thus the person whom Muslims regard as the best human being God ever made seems utterly unconcerned about his followers raping women as part of the spoils of war. Not that we should be surprised, of course,  because Muhammad's God shares His prophet's disregard for the right of slave women not to be raped, since we read this in the Qur'an, where Allah is at pains to teach the believers with whom they are are not allowed to have sex:
And forbidden to you are wedded wives of other people except those who have fallen in your hands (as prisoners of war) .4:24
and this, which lists in more detail the women with whom Muhammad himself can have sex. (Wasn't it good of God to make a special revelation telling humanity forevermore whom the Prophet could bonk?):
O Prophet! We have made lawful to thee thy wives to whom thou hast paid their dowers; and those whom thy right hand possesses out of the prisoners of war whom Allah has assigned to thee; and daughters of thy paternal uncles and aunts, and daughters of thy maternal uncles and aunts, who migrated (from Makka) with thee; and any believing woman who dedicates her soul to the Prophet if the Prophet wishes to wed her;- this only for thee, and not for the Believers (at large); We know what We have appointed for them as to their wives and the captives whom their right hands possess;- in order that there should be no difficulty for thee. And Allah is Oft- Forgiving, Most Merciful. 33:50 

If there is a God (which there isn't) are Muslims not slightly concerned that they may have to justify following such morally dubious teachings? 

("Tell me, my son - why didn't you question such teachings? Didn't you think for yourself for just one moment? Didn't it occur to you ask why? Did you not suspect for one moment that it was all just...gibberish?")

Where is the goodness in such teachings? In what way can this be seen as the behavior of the best human ever? 

Are those Muslims who use this and other similar reports to justify the appalling mistreatment of women in the world today better than those of us kaffirs who fight to highlight the injustice, moral depravity, and cruelty excused in the name of Islam?

Remember - according to Islam, ALL non-believers go to Hell and if you follow the teachings of Islam (such as those examined the above) you will go to Paradise. 

Note: All Sunni (the majority, mainstream) Muslims MUST believe the reports of Muhammad's actions and words as recorded in the sahih (utterly trustworthy) ahadith. Hence all sunni Muslims have to believe that Muhammad thought it acceptable to have sex with slave girls and that all he was concerned with when asked about it was whether one should indulge in coitus interruptus when doing it.

"Best human ever" - hmmm.

Do any Muslims try to justify this? Well they try.  Here's a typical example from sunniforum:
it seems that intercourse with slaves was probably considered a method of contraceptive sexual enjoyment through coitus interruptus (`azl), since the slave owner could practice `azl without prior permission from his slave mate while he could not do so with his free wife without prior permission from her. And if the contraception intended by this `azl failed and the slave woman still bore a child from her master, her child was automatically freed and obtained a son or daughter's rights including inheritance. In addition, the mother herself could no longer be sold and was freed upon the owner's death. From the slave's perspective, the above scenario could have formed an accepted kind of lawful gamble from which she stood to gain much more than to lose. This could be problematized with the claim that "the cost of freedom is therefore rape" but such is just an inflammatory rephrasing of the truism that the cost of a war captive's life is her imprisonment; emancipation from which is a dramatically enhanced possibility in the above scenario.

So that's all right then...rape is acceptable if it dramatically enhances the possibility of  the victim gaining her freedom (by bearing the off-spring of her rapist).

And that's the best they can do?

  1. there are many more similar sahih hadith that paint Muhammad in a very poor light.
    It is interesting that many Sunni Muslim sites try to deny the existence of the more worrying ones (whilst the Shia sites delight in listing them since they (the shias) don't believe in Bukhari and the rest)
    it must be very difficult being a Sunni Muslim nowadays and being able to access all the frankly disturbing and bizarre stuff that you have to believe.
    no wonder many are starting to question.

  3. If Shia Muslims do not accept the Hadiths then how do they make sense of some parts of the Koran, or know basic things like when and how many times to pray, establish Shariah law, model themselves against the lifestyle of Muhammad the so-called perfect human being.

  4. Great post Spinoza :) I wonder how everyday Sunni Muslims deal with this in their heads, and how many even know about it.

    Even the awful attempted justification for sex slavery from sunniforum fails immediately when we look two hadiths earlier, at Sahih Muslim Book 8 number 3371. In that one there is an inconvenient additional detail - the women were due to be ransomed back to their kin, so the raped women do not even have the supposed benefit that it is "a lawful gamble" that might gain them freedom from slavery.

    "Abu Sirma said to Abu Sa'id al Khadri (Allah he pleased with him): 0 Abu Sa'id, did you hear Allah's Messenger (may peace be upon him) mentioning al-'azl? He said: Yes, and added: We went out with Allah's Messenger (may peace be upon him) on the expedition to the Bi'l-Mustaliq and took captive some excellent Arab women; and we desired them, for we were suffering from the absence of our wives, (but at the same time) we also desired ransom for them. So we decided to have sexual intercourse with them but by observing 'azl (Withdrawing the male sexual organ before emission of semen to avoid-conception). But we said: We are doing an act whereas Allah's Messenger is amongst us; why not ask him? So we asked Allah's Mes- senger (may peace be upon him), and he said: It does not matter if you do not do it, for every soul that is to be born up to the Day of Resurrection will be born."

  7. These are not really discussed among 'civilian muslims' (i.e. non-scholar). Subjects on slavery are hardly mentioned. Bukhary abd Muslim sahih hadiths which deals with bizzare decision by the prophet and its companions are not popular subjects in islamic study circles and lectures. Muslims in general, in complementary, hard asked such questions. they are more interested in matters regarding fiqh, i.e. rules and regulations like how to do prayers, ablution, hajj, what is halal and what is haraam. Not sure if this is deliberate (by ulama's) or muslims are just naturally uninterested.

    Another interesting topic which might be bizzare, and has relevance to other Abrahamic religions, is the matter of Judgement day (Qiyamah) and the end of time, involving among others, the return of Imam Mahdi, return of Jesus, and rise of Dajjal (anti-christ). there is a long sahih hadith detailing what will happen during that time. It would be interesting to compare to bible's book of revelation. All religions claim that this end time will eliminate all those who doesn't believe in their religion. many among muslims themselves have claimed to be the Imam Mahdi himself. Many also in the Christian wolrd claims to be Jesus the 2nd coming. Not sure about Jews, perhaps they are just waiting ti be resurrected and climb onto the temple mount (bombing Palestine while doing that).

    Perhaps Spinoza has time to look into that?

  8. It is really something that we have to rely on MAN MADE Geneva Conventions which are humanely more superior to the rules of warfare and treatment of POWs outlined in Islam - that are considered DIVINE by Muslims...

    Unlike Islam, The Geneva conventions EXPLICITLY and more EFFECTIVELY bans mutilations, torture and the rape of female captives regardless of race or creed as well as enslaving whole populations and the executions of captured soldiers regardless of race or creed unlike Islam which allows such practices or at least fails to condemn and ban such practices, for how can you ban enslaving populations, torture and raping non Muslim captive women if Muhammad and the early Muslims practiced it in the name of Islam, nay, how can you ban such cruelty if the Muslim world has been doing this in the name of Islam for almost 1400 years up until Islam’s clash with modernity, in which Muslim countries are forced to make obsolete the, Islamic rules of war (which doesn’t even talk about chemical, biological or nuclear warfare) and subscribe to the Geneva conventions, which by the way were developed in the kuffar west.

    Why didn't Islam (the religion of peace and mercy) take the initiative and show how humane it is and ban slavery, and rape of war captives and better treatment of captured or surrendered soldiers, why didn’t the Islamic world take the initiative and create “The Meccan Conventions” maybe because if they did they’d have to condemn Muhmud Ghazni , Muhammad Bin Qasim, Umar, Abu bakr and Muhammad himself for the practice of war crimes, torture, genocides, slavery , sex slavery and rape of female captives.

    It would be interesting if you Spinoza could do a short article comparing the more humane Geneva Conventions and the injustices and cruelty of Islamic rules of warfare, it would really expose islam.

    On another point How would Muslims feel if the cruel and barbaric rules of Islamic warfare applied to non Muslims were applied back at them...Here's what Pakistani Atheist has to say...

    P.S. it is ridiculous that Islam forbids pre martial consensual sex but allows sex slavery and marital rape, in which there is no consent, to come to think of it, its even more ridiculous that Islam forbids pleasurable masturbation but allows Female and Male genitalia mutilation a bloody and painful practice.

Even in 2014, the legacy of Mohammeds actions can be seen today wahabis taking about sex slaves, boko Haram enslaving school girls and then raping them and of course the new Muslim caliphate Islamic state and its enslaving of non Muslim yazidi women and raping them, no cries or protests from the Muslim world, because Mohammed never cried or protested against the rape of female sex slaves, Muslim world only empathizes with Muslims not kuffars hence their protests against Israel for Gaza, completely inactive or less against Islamic state for yazidis, Christians and even shia Muslims, whom most Sunnis regard as apostates.

The prophet said, "Do you really do that? It is better for you not to do it. No soul that which Allah has destined to exist, but will surely come into existence."

    Narrated Abu Said Al-Khudri that during the battle with Bani Al-Mustaliq they (Muslims) captured some females and intended to have sexual relations with them without impregnating them. So they asked the prophet about coitus interruptus. The prophet said, "It is better that you should not do it, for Allah has written whom He is going to create till the Day of Resurrection".
    Qaza'a said, "I heard Abu Said saying that the prophet said, "No soul is ordained to be created but Allah will create it.""

    Muhaririz said: "I entered the mosque and saw Abu Said al-Khudri. I sat with him and asked about withdrawing the penis (while having intercourse), Abu Said said: We went out with the Apostle of Allah on the expedition to Banu al-Mustaliq, and took some Arab women captive, and we desired the women, for we were suffering from the absence of our wives, and we wanted ransom; so we intended to withdraw the penis (while having intercourse with the slave-women). But we asked ourselves: "Can we draw the penis when the apostle of Allah is among us before asking him about it?" So we asked him about it. He said, "It does not matter if you do not do it, for every soul that is to be born up to the Day of Resurrection will be born.""

  12. 1- Banu Al-Mustaliq were a sub-tribe of Khuzaa‘ah and Al-Mustaliq was their forefather. He was Juthaymah bin Sa‘d bin ‘Amr bin Rabee‘ah bin Haarithah bin ‘Amr bin ‘Aamir bin Maa’is-Samaa’.

    2- The Date of the Battle

    Scholars differ regarding the date of the Battle. Their views may be summed up as follows: Ibn Is’haaq, Khaleefah bin Khayyaat and Ibn Jareer At-Tabari may Allah have mercy upon them said that it took place during the month of Sha‘baan in the 6th year AH. Others, such as Al-Mas‘oodi may Allah have mercy upon him said that it took place during the month of Sha‘baan in the 4th year AH. A third group of the scholars are of the view that it took place during the month of Sha‘baan in the 5th year A.H. Of the earlier scholars who adopted the third view are: Moosa bin ‘Uqbah, Ibn Sa‘d, Ibn Qutaybah, Al-Balaathuri, Ath-Thahabi, Ibn Al-Qayyim, Ibn Hajar Al-‘Asqalaani and Ibn Katheer may Allah have mercy upon them. Of the modern scholars who adopted this view are: Al-Khudhari Bik and Al-Ghazaali may Allah have mercy upon them and Al-Booti, may Allah preserve him.

    Sa‘d bin Mu‘aath, may Allah be pleased with him, died following the Battle of Banu Quraythah, which took place during the month of Thul-Qa‘dah in the 5th year A.H., according to the most preponderant view. This means that the Battle of Banu Al-Mustaliq took place before it.

    3- The reasons behind the Ghazwah of Banu Al-Mustaliq

    The following are the most important reasons behind this Battle

    A- The tribe of Banu Al-Mustaliq supported Quraysh and joined it during the Battle of Uhud against the Muslims. It was among the block of Ahaabeesh tribes who participated in the battle supporting Quraysh.

    B- The tribe of Banu Al-Mustaliq governed the main road leading to Makkah. It was a strong barrier that prevented the Muslims from reaching Makkah.

    C- News came to the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) that Banu Al-Mustaliq were mobilizing an army to fight him under the leadership of Al-Haarith bin Abi Dhiraar. Having heard about that, the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) set out and met them in one of their watering areas called Al-Muraysee‘ in the direction from Qadeed to the sea coast. The Prophet sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) made them taste a bitter defeat there.

    4- Events of the Battle of Banu Al-Mustaliq

    Having learnt about the notorious mobilization of Banu Al-Mustaliq, the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) dispatched Buraydhah bin Al-Husayb Al-Aslami, may Allah be pleased with him, to verify the reports, and he told Banu Al-Mustaliq that he wanted to support them. He stayed with them until he verified their intention, then returned and told the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) and informed him about that.

    On a Monday two nights of the month of Sha‘baan, in the 5th year AH., the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) left Madeenah along with 700 fighters and thirty horses and moved towards Banu Al-Mustaliq. Banu Al-Mustaliq had been informed about Islam and invited to embrace it. They had also joined the polytheists in the Battle of Uhud. They were mobilizing allies to fight the Muslims. The Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) attacked them while they were heedless and their cattle were watering. He killed their fighters and captured their children. Juwayriyah bint Al-Haarith, may Allah be pleased with her, was among the captives. [Al-Bukhari and Muslim]

  13. The Marriage of the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) to Juwayriyah bint Al-Haarith, May Allah Be Pleased with Her

    The Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) distributed the captive women of Banu Al-Mustaliq. Juwayriyah bint Al-Haarith, may Allah be pleased with her, was among the captives and she was a blessing for her people. Let us know about her story from ‘Aa’ishah, may Allah be pleased with her. It was narrated that she said, “When the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) distributed the captive women of Banu Al-Mustaliq, Juwayriyah bint Al-Haarith belonged to the share of Thaabit bin Qays bin Shammaas or one of his cousins. She held a manumission contract with him. She was a beautiful and attractive woman. Anyone who saw her admired her. She came to the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) in order to help her in paying her manumission.”

    ‘Aa’ishah, may Allah be pleased with him, continued

    By Allah, as soon as I saw her at the door of my room, I hated her. I knew that the Prophet sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) would admire her. She entered to see the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) and said “O Messenger of Allah, I am Juwayriyah bint Al-Haarith bin Abi Dhiraar, the chief of his people. I have been afflicted with an adversity that you know [i.e. that she had become a slave woman after she was a free woman and the first lady of her people]. I belong to the share of Thaabit bin Qays bin Shammaas, or a cousin of his, and I hold a manumission contract with him. Here I am seeking your help for the manumission.” The Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) said: “Would you want what is better than this?” She said, “What is that, O Messenger of Allah?” He replied: “I shall pay your manumission and marry you.” She agreed, and then the news spread among people.

    Thereupon, the Muslims released all Banu Al-Mustaliq’s captives as they had become relatives through the marriage of the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ).

    ‘Aa’ishah, may Allah be pleased with him, said, “The marriage of the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) to Juwayriyah, may Allah be pleased with her, was the cause of the setting free of one hundred families of the Banu Al-Mustaliq. I do not know of a woman who was greater in blessing to her people than she was. Following the incident, Al-Haarith bin Abi Dhiraar, Juwayriyah’s father, came to Madeenah with the ransom of his daughter. The Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) invited him to embrace Islam, and he did.”

    The Battle of Al-Muraysee‘ is considered one of the unique and blessed Battles in Islam. Following that Battle, a whole tribe embraced Islam. The reason behind their conversion to Islam was that the Companions, may Allah be pleased with him, freed and returned the captives that were their shares of the booties. They hated to enslave the relatives of the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ). Due to that communal emancipation and unique generosity, the whole tribe embraced Islam.

The far reaching cause of this historical event was the love that the Companions, may Allah be pleased with them, had for the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) honoring him and exalting his great personality. As such, love of the Prophet sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) gives these fine fruits and produces such unique incidents in history.

    There were far reaching aims behind the marriage of the Prophet sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) to Juwayriyah bint Al-Haarith, may Allah be pleased with her, and these aims were achieved when her people embraced Islam. The conversion of her people to Islam was one of the goals behind that marriage. In this way the number of Muslims increased, and Islam became more exalted; thus the hopes behind that marriage were achieved. Allah The Exalted facilitated the marriage, blessed it and realized the goal behind it, as Juwayriyah, may Allah be pleased with her, as well as her father embraced Islam, and then the whole tribe embraced Islam as well. This marriage resulted in blessing and power for Muslims as well as the material and moral support altogether for Islam and the Muslims.

  15. The Marriage of the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) to Juwayriyah bint Al-Haarith, May Allah Be Pleased with Her

    The Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) distributed the captive women of Banu Al-Mustaliq. Juwayriyah bint Al-Haarith, may Allah be pleased with her, was among the captives and she was a blessing for her people. Let us know about her story from ‘Aa’ishah, may Allah be pleased with her. It was narrated that she said, “When the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) distributed the captive women of Banu Al-Mustaliq, Juwayriyah bint Al-Haarith belonged to the share of Thaabit bin Qays bin Shammaas or one of his cousins. She held a manumission contract with him. She was a beautiful and attractive woman. Anyone who saw her admired her. She came to the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) in order to help her in paying her manumission.”

    ‘Aa’ishah, may Allah be pleased with him, continued

    By Allah, as soon as I saw her at the door of my room, I hated her. I knew that the Prophet sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) would admire her. She entered to see the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) and said “O Messenger of Allah, I am Juwayriyah bint Al-Haarith bin Abi Dhiraar, the chief of his people. I have been afflicted with an adversity that you know [i.e. that she had become a slave woman after she was a free woman and the first lady of her people]. I belong to the share of Thaabit bin Qays bin Shammaas, or a cousin of his, and I hold a manumission contract with him. Here I am seeking your help for the manumission.” The Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) said: “Would you want what is better than this?” She said, “What is that, O Messenger of Allah?” He replied: “I shall pay your manumission and marry you.” She agreed, and then the news spread among people.
